The control of mRNA synthesis in the unicellular eukaryote Saccharomyces cerevisiae involves a number of promoter elements, including an upstream activation site (UAS), an RNA initiation element (RIE) and, for some genes, a form of negative element. The UAS is involved in the activation and regulation of transcription, whilst the RIE, which comprises a transcription initiation site (or I site), and often a TATA box, is responsible for the accurate positioning of the 5′ end of the mRNA. This article provides current Schwartz Values Survey (SVS) data from samples of business managers and professionals across 50 societies that are culturally and socioeconomically diverse. We report the society scores for SVS values dimensions for both individual- and societal-level analyses. At the individual-level, we report on the ten circumplex values sub-dimensions and two sets of values dimensions (collectivism and individualism; openness to change, conservation, self-enhancement, and self-transcendence). At the societal-level, we report on the values dimensions of embeddedness, hierarchy, mastery, affective (...) autonomy, intellectual autonomy, egalitarianism, and harmony. For each society, we report the Cronbach’s α statistics for each values dimension scale to assess their internal consistency (reliability) as well as report interrater agreement (IRA) analyses to assess the acceptability of using aggregated individual level values scores to represent country values. We also examined whether societal development level is related to systematic variation in the measurement and importance of values. Thus, the contributions of our evaluation of the SVS values dimensions are two-fold. First, we identify the SVS dimensions that have cross-culturally internally reliable structures and within-society agreement for business professionals. Second, we report the society cultural values scores developed from the twenty-first century data that can be used as macro-level predictors in multilevel and single-level international business research. Debates over these questions involve considerations that range from aesthetics to ethics, from the intrinsic values of the genre to its moral effects. Recently, largely under the influence of the cognitive sciences, the question has taken on a new cast: might science give us a new answer to these long-standing (...) issues? Studies such as Lisa Zunshine's Why We Read Fiction (2006), John Carey's What Good Are the Arts? (2005), and Alan Palmer's Fictional Minds (2004) are part of a growing area of interdisciplinary work on the relationship between art and consciousness.1 This body of work asks not just how our theories of consciousness inform our understanding of the process and function of [End Page 615] reading fiction, but also whether fiction itself might provide a key to new theories about the nature of consciousness.The nineteenth-century novel is often considered the high point in the literary representation of mind. Indeed, the terms "psychology" and "novel" are explicitly yoked in the nineteenth-century with the simultaneous emergence of both as discrete forms of intellectual and artistic activity. Not surprisingly, George Eliot has come to be identified with the term "psychological novel": in fact, Nicholas Dames argues that she was the first to couple the words psychology and novel in this way in an 1855 review where she contrasted Charles Kingsley's historical romance Westward Ho! with "those 'psychological' novels."2 While George Eliot initially used the phrase in what Dames calls "mock disdain," by the end of the nineteenth century the term "psychological novel" had gained currency as a straightforward description of a type of Victorian novel: Wilbur Cross, in his summary The Development of the English Novel, for example, describes the form as "stressing an inner sequence of thought and feeling, which is brought into harmony with an ethical formula and accounted for in an analysis of motive." Along with Elizabeth Gaskell and George Meredith, Cross also cites George Eliot as one of his central examples of the "psychological novel."3It seems natural, then, when a critic asks, "what is the special distinguishing function of the modern art of fiction?" to turn for an answer to George Eliot's novels and their close connections with psychological science. It is perhaps surprising that this still-current question was posed by the nineteenth-century psychologist James Sully (1842–1923) in an 1881 article in the journal Mind on "George Eliot's Art."4 His essay offers us a Victorian contribution to questions about the relationship of literature and psychology that are being addressed today by critics such as Sally Shuttle-worth, Athena Vrettos, Kay Young, Nicholas Dames, or Rick Rylance, especially [End Page 616] with respect to George Eliot. James Sully's essay not only provides valuable insight into how the Victorians themselves understood the role of psychology in the novel, but also helps to place contemporary debates about fiction and consciousness into sharper relief.In the wake of important studies, such as Rylance's Victorian Psychology and British Culture (2000), that have brought renewed attention to nineteenth-century British psychology, recent scholarship has shown the central role of Victorian debates about the mind in shaping the fiction of the period.5 Nineteenth-century mental science provided material and inspiration for works of literature, with imaginative writers eager to exploit and develop the narrative and thematic potential of contemporary psychological discourse and probe the problems it raised. The very first sentence provides the date where the story-world is set, and the lines following describe a setting suitable for that period of time. This is in accordance with the generic tradition of the historical novel. Even if the historical novel has very few characters whom theorists would agree upon, most theories of historical novel concur on the statement that the genre is "by definition referential, gesturing toward a world commonly understood to have existed" (Maxwell 545). This emphasis on the story-world has dominated the study of the historical novel. What I want to stress, however, are the specific ways in which a historical novel—to use Richard Maxwell's words—gestures toward this commonly comprehensible, preexistent world. How is the story-world made understandable to a reader and offered as the past? I want to demonstrate the importance of the literary means that help mediate between the past of the story-world and the present of the reader.The passage above begins with the retrospective view: the narrator refers to a date over two hundred years ago, and the passage is in the past tense. The text does, however, also apply expressions like "now." This indicates a point of view that is present in the story-world, at least in terms of temporality. The impression of a viewpoint present in the story-world is further emphasized by the frequent references to aural experience; the [End Page 21] sounds heard (the bell and the clock) and not heard (silent footsteps and quiet waiting) offer the reader an interpretative position that takes her into the story-world through experience. The origin of the experience, however, is not specified. Two questions arise that are crucial to my argument: Is the experiencing subject located temporally in the story-time or in the narrator's retrospective time? Is there a single experiencing subject? While the first question tackles the relationship between the past tense and the deictic markers indicating the present ("now"), the second question is concerned with features like the hearing of the sound of the bell in the passage: because the hearing is depicted in the passive mode, the hearer could be anybody or everybody.These two questions, the first about temporality and the second about the experiencing subject, intersect in the study of narrative identity. Alan Palmer suggests that in current research on narrative literature the individual consciousness has been emphasized at the expense of the social, and he stresses the importance of studying the latter (136). The title essay, "Consciousness and the Novel," is a revised version of the Richard Ellman Lectures in Modern Literature that Lodge gave at Emory University in 2001, and the other nine essays, all previously published, cover such topics as Howards End; the novels of Evelyn Waugh; The Letters of Kingsley Amis; Martin Amis's memoir, Experience; and the relationship between literature and criticism. I will focus on "Consciousness and the Novel."Lodge's thesis in this essay is that novels play an essential role in our exploration of the nature of human consciousness. This thesis is certainly true, but it is also entirely banal. Much more interesting is what Lodge says in support of it. He argues that because of the unique representative possibilities of the novel, conscious experiences can be represented more effectively in novels than they can be in scientific writing. Taken literally, as an assertion about the relative representational power of novels and scientific discourse, this is extremely implausible. However, taken more loosely—as an invitation to those of us interested in consciousness to take a closer look at the ways conscious experiences are represented in novels—Lodge's claim is sensible and appealing. I will consider the literal reading of Lodge's claim first and then turn to the looser one.It is undoubtedly true that, as a whole, novelists devote more energy to representing conscious experiences than writers of scientific discourse do. However, science writers can use whatever techniques best serve their aims, including the aim of describing conscious experiences, so there is no reason to think that conscious experiences can, in principle, be represented more effectively in novels than in broadly scientific discourse. Given that Lodge discusses such creative science writers as Antonio Damasio, Daniel Dennett, and Steven Pinker in the course of his essay, it is surprising and disappointing to find him caricature scientific writing in the following way: "science... is a third-person discourse. The first-person pronoun is not used in scientific papers. If there were any hint of qualia in a scientific paper... it would be edited out" (p. 11). Qualia are the supposedly subjective qualitative aspects of conscious experiences. How the plucked string of a cello sounds to you; how the rotting fish in the garbage smells to you; and how it feels for you to inch down into the smooth, almost-too-hot water of a perfect bubble bath—these are all (supposedly) examples of qualia. Lodge is simply mistaken when he says that there is no hint of qualia in scientific writing. There is no consensus about whether qualia can be explained scientifically. Nurses have traditionally been regarded as clinicians that deliver compassionate, safe, and empathetic health care (Nurses again outpace other professions for honesty & ethics, 2018). Caring is a fundamental characteristic, expectation, and moral obligation of the nursing and caregiving professions (Nursing: Scope and standards of practice, American Nurses Association, Silver Spring, MD, 2015). Along with caring, nurses are expected to undertake ever‐expanding duties and complex tasks. In part because of the growing physical, intellectual and emotional demandingness, of nursing as well (...) as technological advances, artificial intelligence (AI) and AI care robots are rapidly changing the healthcare landscape. As technology becomes more advanced, efficient, and economical, opportunities and pressure to introduce AI into nursing care will only increase. In the first part of the article, we review recent and existing applications of AI in nursing and speculate on future use. Second, situate our project within the recent literature on the ethics of nursing and AI. Third, we explore three dominant theories of caring and the two paradigmatic expressions of caring (touch and presence) and conclude that AI—at least for the foreseeable future—is incapable of caring in the sense central to nursing and caregiving ethics. We conclude that for AI to be implemented ethically, it cannot transgress the core values of nursing, usurp aspects of caring that can only meaningfully be carried out by human beings, and it must support, open, or improve opportunities for nurses to provide the uniquely human aspects of care. The idea that the use of instruments in science is theory‐dependent seems to threaten the extent to which the output of those instruments can act as an independent arbiter of theory. This issue is explored by studying an early use of the electron microscope to observe dislocations in crystals. It is shown that this usage did indeed involve the theory of the electron microscope but that, nevertheless, it was possible to argue strongly for the experimental results, the theory of dislocations (...) being tested, and the theory of the instrument, all at the same time. This essay explores some concerns about the quality of informed consent in patients whose autonomy is diminished by fatal illness. It argues that patients with diminished autonomy cannot give free and voluntary consent, and that recruitment of such patients as subjects in human experimentation exploits their vulnerability in a morally objectionable way. Two options are given to overcome this objection: (i) recruit only those patients who desire to contribute to medical knowledge, rather than gain access to experimental treatment, or (ii) (...) provide prospective subjects the choice to participate in standard doubleblind study or receive the experimental treatment. Either option would guarantee that patients in desperate conditions are given a more meaningful choice and a richer freedom, and thus a higher quality of informed consent, than under standard randomized trials. In recent months, Covid‐19 has devastated African American communities across the nation, and a Minneapolis police officer murdered George Floyd. The agents of death may be novel, but the phenomena of long‐standing epidemics of premature black death and of police violence are not. This essay argues that racial health and health care disparities, rooted as they are in systemic injustice, ought to carry far more weight in clinical ethics than they generally do. In particular, this essay examines palliative and end‐of‐life (...) care for African Americans, highlighting the ways in which American medicine, like American society, has breached trust. In the experience of many African American patients struggling against terminal illness, health care providers have denied them a say in their own medical decision‐making. In the midst of the Covid‐19 pandemic, African Americans have once again been denied a say with regard to the rationing of scarce medical resources such as ventilators, in that dominant and ostensibly race‐neutral algorithms sacrifice black lives. Is there such thing as a “good” or “dignified” death when African Americans are dying not merely of Covid‐19 but of structural racism? (shrink)

Over 100 years ago, Frances Galton began the empirical study of autobiographical memory by devising a technique in which he explored the capacity for a cue word to elicit the recollection of events from earlier life (Galton, 1883). After a century of neglect, the topic began to re-emerge, stimulated by the work of Robinson (1976) using the technique on groups of normal subjects, by Crovitz’s work on its application to patients with memory deficits (Crovitz & Schiffman, 1974), and by the (...) detailed diary study of her own autobiographical memory carried out by Marigold Linton (Linton, 1975). This early wave of interest was focused by Rubin’s edited book on the topic (Rubin, 1986) which captured a broad and growing interest in autobiographical memory. This trend was reflected very strongly in the submissions to the second conference on Practical Aspects of Memory, in which the study of autobiographical memory represented one of the major strands (Gruneberg, Morris & Sykes, 1988), featuring prominently in both the opening and concluding addresses (Baddeley, 1988; Neisser, 1988). In 1964, the American Medical Association invited liberal theologian Abraham Joshua Heschel to address its annual meeting in a program entitled “The Patient as a Person” [1]. Unsurprisingly, in light of Heschel’s reputation for outspokenness, he launched a jeremiad against physicians, claiming: “The admiration for medical science is increasing, the respect for its practitioners is decreasing. The depreciation of the image of the doctor is bound to disseminate disenchantment and to affect the state of medicine itself” [1, p. 35]. Heschel’s (...) reference to “disenchantment” suggests that he may have been familiar with the work, or at least the outlook, of sociologist Max Weber, whose 1917 address “Science as a Vocation” portrays the modern world as disenchanted by the progress of rationalism. Heschel’s life’s vocation had been to uncover the inner meaning of religious faith and to translate that faith into principled action. Heschel saw disenchantment not as an inescapable aspect of modern life but rather as the byproduct of physicians’ conscious choices to seek worldly success and material comfort. Yet, because of their privileged position as witnesses to human vulnerability, physicians possess an obligation to develop their own personhood, to re-enchant medicine, and through medicine to spark a positive transformation in all of modern life. As Heschel says, “The doctor must realize the supreme nobility of his vocation, to cultivate a taste for the pleasures of the soul. … The doctor is a major source of moral energy affecting the spiritual texture and substance of the entire society” [1, pp. 34, 38]. While Heschel’s conception of the physician’s role is romanticized and idealized, changes in the organization and practice of medicine have validated his concerns. (shrink)

Every perceptual experience has an objective and a subjective side. We see object size, independent of distance, but we also see that distant objects project smaller images. Early modern conceptions focused on local stimulation and thus on the subjective aspect. Helmholtz and Hering emphasized the objective aspect. Helmholtz split visual experience into two stages, with sensation representing the subjective side and perception, through cognitive processes, the objective side. Gestalt theory denied this dualism, rejecting both sensory and cognitive stages. Despite contrary (...) evidence, the sensation/perception dualism persists, in brightness models and past experience theories. That we can detect visual angle and luminance does not mean that these are raw sensations out of which perception of size and lightness is built. Size and color constancy are truly visual, not cognitive. Instructions to subjects in vision experiments must avoid the proximal mode on the one hand and cognitive judgments on the other. (shrink)

While e-commerce has grown rapidly in recent years, some of the practices associated with certain aspects of marketing on the Internet, such as pop-ups, cookies, and spam, have raised concerns on the part of Internet users. In this paper I examine the nature of these practices and what I take to be the underlying source of this concern. I argue that the ethical issues surrounding these Internet marketing techniques move us beyond the traditional treatment of the ethics of marketing and (...) advertising found in discussions of business ethics previously. Rather, I show that the questions they raise ultimately turn upon questions of technique and the ways in which technologies can transform the fundamental means by which relationships are established and maintained within a social environment. I then argue that the techniques of e-commerce are indeed transforming the means by which businesses relate to consumers, and that this transformation is affecting the applicability of our previous ways of demarcating the imperatives determining the limits of accessibility between consumers and businesses. Properly addressing the ethical status of the techniques of e-marketing as such necessarily moves us to consider the changes that Internet commerce are having upon the norms that govern individuals in their relations with others. In an increasingly global landscape, NFP initiatives including those addressing animal protection, are increasingly operating cross-borders. Doing so without respect, local engagement, and a thorough understanding of the issues of concern is fraught with danger, and potentially wasteful of resources. To this purpose, we sought to understand attitudes to the importance of 13 major world social issues in relation to animal protection by surveying 3433 students from at least 103 universities across 12 nations. The emergence of a ‘nature trifecta’ was (...) suggested, with animal and environmental protection and sustainable development recurring as the most highly rated in importance across all countries, with these issues also consistently rating amongst the highest in each individual country. It is concluded that significant differences exist between attributed importance of world issues by nation, pointing towards the benefit of tailoring NFP initiatives by country and region. It is also suggested that nation, or more specifically, sociopolitical and cultural region, is a vitally important demographic for consideration in social development. (shrink)

In the popular folklore three-score-years-and-ten is treated as a fair innings for people, and thereby serves as an informal reference point for judgements about distributive justice within a community. But length of life alone is an insufficient basis for such judgements - a person's health-related quality-of-life also needs to be taken into account. If one of the objectives of public policy is to reduce inequalities in lifetime health, it will be demonstrated that this is very likely to require systematic discrimination (...) against the older members of a community. The notion of community solidatity will also be tested, because a decision will need to be made as to whether the same fair innings applies to all members of the community, or whether some are entitled to more than others. The strength of the fair innings principle is that it brings these issues to the fore in a systematic way which should ais their resolition in a practical context. (shrink)

This paper argues the case that tests of how investors value corporate social performance (CSP) based upon realised stock market returns are liable to be weak tests if markets are efficient and firms change CSP policies infrequently. We provide a theoretical explanation of why this will be the case using examples to illustrate. Subsequently, we set out an alternative theoretical framework for the purposes of investigating whether markets place a positive, or a negative, valuation on CSP, and show why this (...) is superior to tests based upon Tobin’s Q. Using US KLD data, we demonstrate that, as theorised, markets place a positive value on CSP that is not detected by conventional returns-based tests. Our conclusion is that researchers who are interested in the question of whether engagement with a corporate social responsibility agenda is a value-enhancing activity for a company (as argued by some stakeholder theorists) or value destructive (as argued by Friedman, The social responsibility of business is to increase its profits, The New York Times Magazine, 1970), need to look beyond returns-based tests to answer the research question posed. It is frequently claimed that breeding animals that we know will have unavoidable health problems is at least prima facie wrong, because it harms the animals concerned. However, if we take ‘harm’ to mean ‘makes worse off’, this claim appears false. Breeding an animal that will have unavoidable health problems does not make any particular individual animal worse off, since an animal bred without such problems would be a different individual animal. Yet, the intuition that there is something ethically wrong (...) about breeding animals—such as purebred pedigree dogs—in ways that seem negatively to affect welfare remains powerful. In this paper, an animal version of what is sometimes called the non-identity problem is explored, along with a number of possible ways of understanding what might be wrong with such breeding practices, if it is not that they harm the animal itself. These possibilities include harms to others, placeholder arguments, non-comparative ideas of harm, an ‘impersonal’ approach, and concerns about human attitudes and dispositions. (shrink)

We argue that the privatisation of education needs to be understood through an ethical lens, and suggest a broad framework through which privatisation policies and practices might be ethically audited. These policies and practices -- it is suggested -- are creating new ethical spaces and new clusters of goals, obligations and dispositions. Whatever the merits of our particular reading of these changes, we would call for an urgent public debate on these questions -- one that looks beyond broad ideological questions (...) to consider the effects of privatisation on the nature of the services provided. Beardsley's Aesthetics, and developments therefrom,2 consolidated and crystallized a tendency in aesthetics that had begun to emerge at least by the time of the publication of Francis Hutcheson's An Inquiry Concerning Beauty, Order, Harmony, Design,3 which tendency, following Beardsley, we can call the aesthetic theory of art. Assembled out of parts and suggestions from Hutcheson, Kant, Schopenhauer, and Bell, among others, the aesthetic theory of art—of which Beardsley's version is one of the most accomplished, if not the most accomplished—has shown remarkable resilience, continuing to command allegiance from many distinguished, contemporary proponents, including Nick Zangwill, Gary Iseminger, and, with certain important modifications, Alan Goldman and Malcolm Budd.Part of what I would like to do in this essay is not only to trace the evolution of the aesthetic theory of art from its origins through to Beardsley's Aesthetics (and his subsequent tinkering with this masterwork) but also to show how the structure of the aesthetic theory of art, as crafted by Beardsley, is simultaneously so elegant, comprehensive, and systematic that it is understandable that Beardsley preferred constantly to repair it after each attack rather than to abandon it for the kinds of alternatives being proffered by Goodman, Danto, Wollheim, Dickie, Wolterstorff, and then Walton. In other words, Beardsley's reluctance to give up was genuinely motivated. [End Page 2] For, if only the kinks could have been smoothed out of it, the aesthetic theory of art, of the sort initiated in Aesthetics and elaborated subsequently by Beardsley, was itself a thing of beauty: exceedingly economical in its foundational principles and powerful in its reach. Thus, whereas typically I address the shortcomings of the aesthetic theory of art, in this essay I would like to talk about its strengths, strengths that I believe encouraged Monroe Beardsley to stick with it through thick and thin—that is, through a thick swarm of often thin counterexamples.In the next part of this essay, I will try to place Aesthetics historically in the course of Western aesthetics. Then in the final section, I shall attempt to explain how the structure of the sort of aesthetic theory of art incipient in Beardsley's Aesthetics and pursued by him in later works is so almost irresistibly attractive that virtually no number of anomalies can shake its friends out of the faith that such problems can be ultimately controlled, if not entirely overcome.On the Historical Significance of Beardsley's AestheticsBeardsley's Aesthetics is the culmination of certain tendencies that had been coalescing in various ways in Western aesthetics since the eighteenth century. One of Beardsley's most significant and influential twentieth-century predecessors was Clive Bell, who in his book Art, as is well known, defined art as that which possessed significant form. Significant form, in turn, was characterized as that which caused an aesthetic emotion. Bell's notion of an aesthetic emotion, I conjecture, derived from Schopenhauer's claim that what an artwork does is to lift us out of our everyday concerns—out of the world of striving. The aesthetic emotion, according to Bell, is a matter of being carried "out of life into ecstasy."4 The aesthetic experience, according to the Schopenhauer-Bell line of thought, involves the release of the individual from the pressures of life—from the pursuit of an endless process of desiring in Schopenhauer's lingo.This notion of aesthetic experience as detachment owes something to Kant's hypothesis that an authentic aesthetic judgment is disinterested, which, of course, itself is descended historically from Hutcheson's contention that beauty amounts to an experience of disinterested pleasure. This article compares the dialectics of Fredric Jameson and Roy Bhaskar. From a dialectical critical-realist standpoint, it argues that Jameson’s approach in his recent collection Valences of the Dialectic sits uncomfortably between Hegelian and Marxist presuppositions. This is seen in the way he configures the relation between thinking and being, and it leads to an alliance with poststructuralist thinking in which real negativity is denied.
